Can a pet deposit be taken out of a rent payment without letting the tenant know?

We are renting a home in california with century 21, we have been living here for a couple months and had not yet paid the pet deposit of 280. We paid the rent on time on the 1st and on the 5th we got a phone call from an agent telling us that she had taken out the pet deposit from our rent payment and that we had not paid the rent in full because of the withdraw. Now we are getting a 3 day notice for not paying the rent in full and we cannot afford this until this upcoming Monday. Is it legal for them to do this without our authorization? what can we do if it isn't?|||Money owed is money owed, period. Of course they can evict you for nonpayment.





In all actuality, they shouldn't have let you moved in before you paid the deposit. You squandered a huge favor they offered, and are now mad because they aren't letting you leech anymore?





Pay up or get out, now. If you can't afford the pet deposit, then you can't afford a pet. If you can't pay all deposits, plus first and last month's rent PRIOR to moving in, then you can't afford to be renting. Maybe you should look into staying with friends or family for awhile until you get on your feet, assuming you can find someone willing to take a pet in. Of course, I would get rid of the pet before becoming homeless.|||Yes. Any money ever given to the landlord can be applied to any money currently owed. If that includes a pet deposit then it is legal. NO landlord ever needs any tenant's authorization to do that. They clearly got tired of you not paying the deposit.





Just so you know, they could have applied the $ to the rent %26amp; still evicted you for not paying the deposit. Either way you still owe them money. You are the one that has not paid the deposit after a couple months %26amp; you have to deal with that.|||You seem to be aware of this pet deposit fee, so I'm betting it is in your rent contract. Ask them for a copy of it. If there's no mention of the deposit, then you have a legitimate dispute. If it is mentioned...you need to find a means to pay the rent.





If that's the case, I suggest borrowing the $280 from friends or family and then honoring that loan. But if no one can help you out, you may need to look into those quick loan places you see everywhere such as Check Into Cash. They would take the money from your next payroll, plus a fee.





You might also ask your Century 21 office if they will work with you until Monday. Can't hurt to ask.
